NYC Code Requirements — What Every Business Owner Should Know

NYC Building Code Chapter 32 governs encroachments into the public right-of-way — which is what a vestibule does any time it extends past your building’s property line onto the sidewalk. Here’s what the rules say:

For restaurants and eating/drinking establishments (BC § 3202.3.2.1): Your temporary storm enclosure can extend beyond the building line by up to 25 square feet in area, provided you maintain a minimum 5-foot unobstructed sidewalk path and comply with ADA door maneuvering clearances. This is the larger allowance, introduced in the 2022 NYC Building Code specifically to support restaurants.

For all other businesses (BC § 3202.4.2): Your enclosure may project no more than 18 inches beyond the street line. This applies to retail, offices, medical practices, gyms, salons, and any non-food-service business.

Materials

Light-transmitting plastics (polycarbonate, acrylic, plexiglass) must meet fire resistance and smoke-density standards under BC § 2606.4. Individual plastic sections cannot exceed 300 square feet and cannot be attached above 50 feet from grade. Canvas fabric panels must be fire-rated, typically to NFPA 701 standards for textile materials used in structures.

Accessibility

If your entrance is an ADA-required accessible route, your vestibule must also be accessible — compliant door widths, no raised thresholds, and proper maneuvering clearances inside.

Season

November 15 – April 15 only. The enclosure must be fully removed by April 15 each year.
